Plum Market’s Hume Giveaway for the Pendry West Hollywood: Official Rules
- 1. EligibilityThe Plum Market x Hume Giveaway for the Pendry West Hollywood (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States (including the District of Columbia) who (a) are at least eighteen (18) years old or the age of majority in the state of their residences, whichever is older, (b) are members of Sponsor’s reward and loyalty program at the time that Entrant purchases the Hume products in subsection (c) below and (c) purchase a minimum of one (1) Hume Supernatural product (including without limitation Hume deodorants or Hume Body oils), inside a Participating Plum Market Store (drive-up, delivery, in-store pickup, and e-commerce purchases do not qualify for an entry into the Sweepstakes or entitle the purchaser to a chance to win the Grand Prize), between October 9, 2023 and October 31, 2023 using your Plum Market rewards account number (“Entrant(s)”). Collectively, subsections (a) through (c) in the previous sentence are referred to as the “Sweepstakes Entry Criteria”. Employees and immediate family members of employees of Plum Market Corporation, Inc., West Bloomfield Market, LLC, Bloomfield Township Market, LLC, Plum Market Food Service, LLC, Plymouth Road Market, LLC, Aventura Market, LLC, and Ann Arbor Market, LLC (collectively, “Plum Market”) are not eligible to enter. For purposes of the Sweepstakes, immediate family members, include, but are not limited to, brothers, sisters, children, step-children, and grandchildren. Sponsor has sole authority to determine whether an Entrant is eligible for the Sweepstakes.The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited and outside the United States. Participation in the Sweepstakes, without opting out, constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions as to the administration and operation of the Sweepstakes and the selection of the Grand Prize winner (as defined below), which are final and binding in all matters related to the Sweepstakes. Winning the Grand Prize (as defined below) is contingent upon fulfilling all requirements set forth herein.2. Sweepstakes Entry Period
The Sweepstakes entry period begins on October 9, 2023 at 12:00 a.m. Eastern Time (“ET”) and ends on October 31, 2023 at 11:59 p.m. ET (the “Sweepstakes Entry Period”). For purposes of the Sweepstakes, Sponsor’s computer is the official time-keeping device for this Sweepstakes.
3. How to Enter
Any Plum Market rewards member who (a) makes a purchase of a Hume Supernatural product at any of the four (4) Participating Plum Market Stores (as defined below) during the Sweepstakes Entry Period, (b) scans his or her reward card or provides the customer service team member with his or her personal information so that the Entrant’s respective reward’s account can be looked up at the time of purchase, and (c) who otherwise meets the Sweepstakes Entry Criteria will automatically be entered into the Sweepstakes drawing. The participating store addresses are as follows: West Bloomfield Plum Market location (6565 Orchard Lake Road, West Bloomfield, MI 48322), the Bloomfield Plum Market location (3675 W. Maple Road, Bloomfield Township, MI 48301), the Aventura Plum Market location (17801 Biscayne Blvd, Aventura, FL 33160), the Ann Arbor Plum Market locations (375 N. Maple, Ann Arbor, MI 48103 and 3601 Plymouth Road, Ann Arbor, MI 48105). Each store location in the preceding sentence is a “Participating Plum Market Store” and, collectively, all of the stores in the preceding sentence are referred to as the “Participating Plum Market Stores”. For purposes of clarification, drive-up, in-store pickup, delivery, and e-commerce purchases do not qualify the purchaser for an entry into the Sweepstakes or entitle the purchaser to a chance to win the Grand Prize.
Limit: Entries are limited to one entry per reward account number per day. Multiple Entrants are not permitted to share the same Plum Market rewards account number. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple/different Plum Market rewards numbers, identities, registrations, or any other methods will void that Entrant’s entry and that Entrant may be disqualified from the Sweepstakes drawing. In the event of a dispute as to any entry, the authorized account holder of the Plum Market rewards account number used to enter the Sweepstakes will be deemed to be the Entrant. The “authorized account holder” is the natural person identified in Plum Market’s rewards database as the person assigned to each respective rewards account number. The Sweepstakes’ Grand Prize winner may be required to show the Sponsor proof of being the authorized account holder.
Opting out of the Sweepstakes: At any time during the Sweepstakes Entry Period, any Plum Market rewards member can opt out of being entered into the Sweepstakes by calling (248) 706-1600 and speaking with the operator, Allison Schleftstein. Additionally, every Entrant shall have the right to reject the Grand Prize if such prize is awarded to said Entrant. Participation in the Sweepstakes, without opting out, constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions as to the administration and operation of the Sweepstakes and the selection of the Grand Prize Winner (as defined below), which are final and binding in all matters related to the Sweepstakes. Winning the Grand Prize (as defined below) is contingent upon fulfilling all requirements set forth herein.
5. Grand Prize Winner
On or about November 13, 2023, after the end of the Sweepstakes Entry Period, Sponsor will select one (1) entry for the Grand Prize using a random, computer-generated, drawing from among all valid entries received during the Sweepstakes Entry Period. The potential Grand Prize winner will be contacted using the email address and/or telephone number associated with the potential winner’s Plum Market rewards number (subject to verification of eligibility and compliance with the terms of these Official Rules). The potential winner will be notified approximately two (2) business days after the prize drawing. Failure to respond to the initial verification contact within three (3) calendar days of notification may, in Sponsor’s sole discretion, result in a forfeiture of the Grand Prize and a disqualification of the potential winner. In the event that a potential Grand Prize winner is disqualified for any reason or the Grand Prize is forfeited or goes unclaimed by a potential winner, Sponsor will award the Grand Prize to an alternate winner by a random, computer-generated, drawing from among all eligible entries. Sponsor will conduct three (3) alternate drawings, after which the Grand Prize will remain unawarded.
6. Verification of Grand Prize Winner
All potential winners are subject to verification by Sponsor. An Entrant is not a winner of any prize, unless and until Entrant’s eligibility and the potential winning entry have been verified and Entrant has been notified that verification is complete. The potential Grand Prize winner(s) may be required to sign and return to Sponsor, within five (5) calendar days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize. If a potential Grand Prize winner cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release, or if the Grand Prize notification is returned as undeliverable, the potential Grand Prize winner shall forfeit the prize. Receiving a prize is contingent upon compliance with these Official Rules.
7. The Grand Prize
One (1) Grand Prize will be awarded. The Grand Prize winner (“Grand Prize Winner”) will receive:
A total of two (2) night’s stay in a standard room, with either two queen beds or one king bed, at the Pendry West Hollywood, in West Hollywood, CA (the “Pendry”), subject to availability (certain weekends or holidays may not apply). The Grand Prize Winner must visit the Pendry between the official notice date and October 31, 2024 in order to claim this portion of the prize.
A $500 Delta Gift Card.
The approximate total retail value of the Grand Prize is USD $1,000.00.
All travel-related, entertainment, and other expenses not set forth herein, including but not limited to food, beverages, entertainment, ground and other transportation, parking, gratuities, baggage fees, and incidental hotel expenses, are the sole responsibility of the Grand Prize Winner. In addition, the Grand Prize Winner is responsible for all taxes, license costs, title fees, insurance, and other expenses related to the Grand Prize. The Grand Prize Winner and his/her guest must commence and complete the trip before October 31, 2023 (certain weekends or holidays may not apply). If the Grand Prize Winner is unable to travel on the dates provided by Sponsor, then the prize will be forfeited and no additional prize will be awarded. Travel companions under the age of eighteen (18) years must be accompanied by a parent or legal guardian and must travel on the same itinerary and at the same time as the Grand Prize Winner. The Grand Prize Winner and his/her travel companion may be required to sign a release before going on the trip. All federal, state, and local taxes and all other expenses not expressly listed in these Official Rules are the sole responsibility of the Grand Prize Winner. The Grand Prize is nontransferable and may not be substituted or redeemed for cash by the Grand Prize Winner. Sponsor reserves the right to substitute the Grand Prize, in whole or in part, for one of equal or greater value. The refusal by an Entrant to accept the Grand Prize releases and forever discharges the Released Parties of all obligations related to the Grand Prize and said Entrant, including delivery. The odds of winning the Grand Prize depend on the number of entries received during the Sweepstakes Entry Period.
8. Entry Conditions, Release, Indemnification, and Limitation of Liability
By entering and/or participating in the Sweepstakes, each Entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless Plum Market, and each of its respective direct or indirect parents, subsidiaries, affiliates, related entities, suppliers, distributors, advertising/Sweepstakes agencies and each such company’s officers, directors, members, employees, contractors, and agents (collectively, the “Released Parties”) from and against any and all losses, liability (including attorney fees), illness, injury, claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt, possession, use or misuse of the Grand Prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, Entrant agrees that, by entering and/or participating in the Sweepstakes, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (iii) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, including any and all rights to have damages multiplied or otherwise increased.
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by any Entrant, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of the Grand Prize. If, for any reason, the Sweepstakes cannot be executed as planned, including, but not limited to, any governmental order, pandemic, force majeure, social media mandate, printing, administrative or other error of any kind, transmission failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Sweepstakes, or if the Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right, in its sole discretion, to cancel, modify or terminate the Sweepstakes and, if terminated before the original end date, to select the winners from among all eligible, non-suspect entries received as of the date/time of termination. If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is to submit another Sweepstakes entry.
9. Publicity
Except where prohibited, participation in the Sweepstakes constitutes Entrant’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes worldwide, in perpetuity, in any and all media, manner, and formats now known or hereafter devised, without further payment or consideration.
10. General Conditions
Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the Grand Prize at random to any eligible Entrant who has registered up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of the Sweepstakes or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. Disputes
Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan or the appropriate Michigan state court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, including any and all rights to have damages multiplied or otherwise increased. Entrant further agrees that any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes, or any prize awarded shall be resolved individually, without resort to any form of class action. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
12. Entrant’s Personal Information
Information collected from Entrants is subject to Sponsor’s Privacy Policy, which is available at http://www.plummarket.com/store/privacy-policy.
13. Grand Prize Winner
The name of the Grand Prize Winner will be posted on Sponsor’s website after the winner confirmation process is completed.
